In Alabama, a parent with primary physical custody is a custodial parent. The other parent is then known as a non-custodial. Typically, non-custodial parents are responsible for providing child support to custodial parents. In cases where the father is the custodial parent, he has the right to receive child support from the mother, just as a custodial mother would from the father.

Applying for Child Support

To receive child support in Alabama, custodial parents must file a petition with the court. This process begins with completing the necessary paperwork. This includes the Child Support Obligation Income Statement/Affidavit (CS-41) and the Child Support Guidelines Notice of Compliance (CS-43). Additionally, custodial parents must provide documentation of their income. This includes any relevant expenses, such as daycare or healthcare costs.

Once the paperwork is submitted, a hearing will be scheduled. A judge will review the case and decide on the proper amount of child support. If the non-custodial parent doesn’t agree with the judge’s decision, they have the right to appeal the ruling.
